Pranesh Prakash, co-founder of the Centre for Internet and Society, cautioned against hasty regulations that could stifle innovation and create a precedent for censorship.

“The IT Ministry is not responsible for ensuring that all AI-generated content adheres to parliamentary language. The real concern is whether regulatory pressure will push companies into excessive self-censorship, thereby chilling free speech,” Prakash explained.

The debate touches on deeper issues of accountability—should X be held responsible for what Grok says? Under Section 79 of the IT Act, platforms generally enjoy immunity from third-party content. However, this protection comes with obligations, including acting against content that violates laws.

Elon Musk, never one to shy away from controversy, responded to the uproar with a laughing emoji on X. His lighthearted reaction suggests he sees the backlash as overblown, in line with his vision of Grok as an “anti-woke” AI alternative.

Musk has previously criticized AI models like ChatGPT and Google’s Gemini for what he perceives as left-leaning biases. In an interview last year, he said, “I’m worried that AI is being trained to be politically correct rather than truthful.” His goal with Grok was to create a chatbot that gives “spicy” and unfiltered responses. Just last year, the government introduced, then withdrew, an AI advisory that sought to impose stricter content moderation rules on AI-generated media. The pushback from tech firms and free speech advocates led to its retraction, but the underlying concerns remain.

India’s laws already place restrictions on speech that can incite violence or disrupt public order. The question now is whether these laws should extend to AI. Meghna Bal, director at the Esya Centre, argues that context matters. “Whether AI-generated content qualifies as free speech depends on whether it crosses legal boundaries. The law does not distinguish between AI and human speech when it comes to prohibited content.”

For now, Grok remains active in India, but its future hangs in the balance. If the government decides to take action, X may have to modify Grok’s responses or implement stricter content moderation measures.
